Version 1.0
Effective date: 16 November 2026.
Provider: Mesut Yilmaz, an individual operating AthletEye.
Country: United States.
State: Texas.
Contact: athleteye@gmail.com
1. About these Terms
These Terms describe the agreement between you and the provider identified above, referred to as “AthletEye”, “we”, “us” or “our”. The “Service” means the AthletEye iOS and Android mobile applications and the related services expressly offered under these Terms. The AthletEye website hosts an accessible copy of these Terms for mobile application users. References to “you” include a person using the Service and, where applicable, an organisation that the person is authorised to represent.
Before you create an account or buy a subscription governed by these Terms, we will make the Terms available for you to review. If you do not agree, do not complete that registration or purchase. Any required acceptance must be obtained through the relevant registration or purchase process; publishing this page alone does not change an existing agreement.
Features may differ between supported mobile platforms, application versions and plans. Describing a feature here does not mean that it is available on every device, in every country, or under every plan. Any plan-specific commitments made at purchase remain applicable.
Some rights depend on whether you are a consumer under local law. Nothing in these Terms removes a legal right or remedy that cannot lawfully be limited by agreement.
Section 25 supplements these Terms for the consumers and transactions it covers. If a regional provision conflicts with a general provision, the regional provision applies to that issue, subject always to mandatory law. Specific purchase commitments remain part of the agreement. Definitions appear in section 26.
2. Eligibility and available countries
You must be at least 13 years old to create an AthletEye account or use its account-based services. Children under 13 are not eligible. If applicable law requires a higher minimum age for your use, that higher age applies.
You must also satisfy any legally required conditions for entering into this agreement and for the processing of your information. AthletEye does not currently offer a parental-authorisation process. Where such authorisation is legally necessary for your access, you are not eligible to use the account-based services unless and until we can support that access lawfully. A declaration that you accept these Terms does not replace any legally required authorisation.
AthletEye is intended for distribution across the countries and regions supported by the Apple App Store and Google Play. Actual access is subject to availability and applicable legal restrictions. Distribution through a store is not a representation that every feature or age group is eligible in every region.
You must provide accurate eligibility information and must not evade an age restriction, lawful access restriction or account suspension. If you act for a club or another organisation, you must have authority to do so. Creating a team does not by itself authorise you to bind its members to a contract.
App-store content ratings may differ by country and device. They do not replace these account eligibility requirements or any applicable legal restrictions.
You must not access, obtain or transfer the Service in breach of sanctions or export-control laws that apply to you or to our provision of the Service. We may restrict a prohibited transaction or access where those laws require it, taking account of applicable licences and exemptions. Store availability does not override these restrictions.
3. What AthletEye provides
AthletEye provides tools for sports coordination and communication. Depending on the available feature and your plan, you can create a player profile, create or join a team, arrange team matches or training, respond to invitations, manage attendance and team activities, exchange messages, and discover other players.
Player profiles may include sports information, match statistics and feedback. Discovery features may use a selected city, an availability setting and other displayed filters. A search result, invitation, rating or availability indicator is information to help coordination; it is not a booking, an employment offer, an identity check or a guarantee that a person will attend.
For the current service, users arrange their own matches and meetings. AthletEye provides the coordination tools and does not act as the organiser of those activities. A listing or invitation does not establish that AthletEye has inspected a venue, checked a participant's background, supplied insurance or guaranteed an event's safety. Any separate arrangements made by users remain their arrangements.
If AthletEye later offers events that it organises itself, the organiser, responsibilities, charges and applicable terms will be identified before users join those events. The current description of user-organised activities does not automatically extend to a future AthletEye-organised service.
4. Accounts and account security
Keep the information needed to operate your account accurate and keep access to your sign-in methods secure. Do not impersonate another person, use another person's account without permission, or sell or transfer an account without our written agreement.
You are responsible for your own use of the Service and for use that you authorise. This does not make you automatically responsible for every unauthorised action, or remove our responsibility for our own security obligations.
Contact us promptly if you suspect account misuse. We may take proportionate steps to secure an account and ask for information reasonably necessary to confirm ownership before restoring access. We will not ask you to disclose a sign-in password or one-time authentication code to a support agent.
Do not create accounts through bots or other unauthorised automated methods, or use additional accounts to evade restrictions or suspensions, manipulate feedback, impersonate others or circumvent free-trial eligibility conditions. Administrative rights in a team do not authorise sharing another person's sign-in credentials.
You may maintain more than one AthletEye account, including on the same device, provided that each account and its use comply with these Terms. Different people may also use their own accounts on a shared device. Creating or using another account does not exempt you from any applicable age, access or conduct restriction.
Linking supported sign-in methods to an account is optional, using the linking options available in your application. Using a different sign-in method does not automatically connect separate accounts. If you wish to access the same account through another method, use an available linking option rather than assume that a separate sign-in will access your existing account.
5. Teams, invitations and participation
A team continues to be available to its remaining members when the person who created it leaves the team. If other members remain and you are the last administrator, you must appoint another administrator before leaving. Only the last remaining member can use the team-deletion action; creating the team does not give an ongoing right to delete it while other members remain. Account deletion is a separate action, addressed in section 16.
Team administrators are responsible for the accuracy of the team and event information they enter and for using their administrative permissions fairly and lawfully. They must have permission to upload material on behalf of a club or another person.
Team membership, an invitation or an attendance response does not establish employment, agency or a partnership with AthletEye. Do not claim that a team or player is endorsed by AthletEye without written permission.
Before attending an event, confirm the time, venue, participation requirements, organiser and any separately arranged costs. Update your attendance response when your plans change. Organisers should communicate significant changes to participants and provide accurate information about any rules or separate arrangements that apply.
Attendance tools, equipment lists, formations and match records support coordination. They do not ensure that a venue is available, that equipment is safe or that a participant is qualified for a particular activity.
6. Sports activities and personal safety
Sports and meeting people in person can involve injury, illness, property loss and other risks. Consider your circumstances and the conditions of the activity before taking part. Follow venue rules, use appropriate equipment and do not encourage others to participate in unsafe or unlawful conduct.
Profile information, scores and activity records are not medical advice or assessments of fitness to participate. Obtain appropriate professional advice where you need it. Messaging and notifications are not emergency services; contact the relevant emergency service when urgent help is needed.
These practical responsibilities do not waive any claim that applicable law does not allow you to waive. In particular, this section is not a release of liability for our own acts or omissions where such a release would be unlawful.
An organiser's use of AthletEye does not replace any permissions, safety measures, venue arrangements or insurance that the organiser is responsible for obtaining. These responsibilities do not remove any duties that applicable law places on AthletEye.
7. Player discovery, statistics and feedback
Discovery results depend on the information provided, the available players and the current settings. Approximate distance and availability information can become inaccurate or out of date. Confirm important details directly before relying on them.
Ratings, attendance indicators and sports statistics may reflect information supplied by other users or calculated from recorded activities. They do not certify a person's identity, trustworthiness, safety or sporting ability.
Provide feedback honestly and only on a proper basis. Do not coordinate false ratings, retaliate against a person through ratings, buy favourable feedback or manipulate attendance records. If you believe a record is inaccurate or abusive, contact athleteye@gmail.com and identify the record and the reason for your concern.
7.1 Location permission and discovery visibility
Device location and permission. Features that use device location may request access to help you find nearby cities or places, for example when choosing a profile city or an event venue. We will explain the purpose and request the relevant device permission before accessing device location, and obtain any additional consent required by applicable law. Accepting these Terms does not itself grant device access or replace such consent. You can decline the request or withdraw permission in your device settings. Depending on the platform and version, city or venue selection and other features that need this access may then be unavailable or limited; this does not itself cancel your account or subscription.
What other users can see. When you make yourself available for player discovery, other users who can view your discovery profile may see your selected city and an approximate distance, where the relevant location information is available. That distance is calculated between the coordinates of the cities saved in your profile and the viewing user's profile, not between your current physical positions. It is not a live location or movement indicator and may not reflect your actual proximity to another person. The city and approximate distance displayed may still reveal information about the area you have chosen for your profile.
Saved information and controls. You can change your selected city through the profile's city settings and use the discovery availability control to manage whether you are available for discovery. Withdrawing device location permission does not automatically erase a previously saved city or change your discovery availability. To manage that visibility, use those separate controls; contact athleteye@gmail.com if you need help or wish to request removal of saved location information. Changes do not recall information that another user has already seen or copied. Any applicable erasure or other privacy rights remain unaffected.
Privacy and separate choices. The Privacy Policy explains the processing of device location and saved city information, including purposes, relevant recipients, retention and privacy rights. Device location permission, choosing a profile city and making yourself available for discovery are distinct choices; permission to access the device does not itself authorise every use or disclosure of location information. These Terms are not blanket consent to location tracking, advertising or unrelated processing. Where a separate consent is required for a particular use or disclosure, we will obtain it separately before that processing.
8. Messaging and communication
Use team and direct messages for legitimate communication connected with the Service. Respect another person's decision not to communicate. Do not evade a rejected request, any restriction or a person's request to stop contacting them.
New direct conversations may require the recipient to accept a message request before further messages can be sent. Features for editing, deleting or reacting to messages operate as explained in the interface. They do not give a right to contact another person indefinitely.
Either participant in a direct conversation can use the “Delete chat” option to delete the entire conversation, including both participants' messages, from the Service for both participants. The deletion applies to the other participant's conversation history as well as your own. This is a different action from deleting your account, as explained in section 16.
A recipient may already have read or copied information before you edit or delete it. Deleting a message or conversation cannot recall a screenshot or another copy outside our control. Any applicable handling of backups or legally retained records is explained in the Privacy Policy.
Delivery, read, presence and typing indicators may be delayed or inaccurate. Notifications can depend on device settings and external delivery services. Do not rely on them for emergencies or as conclusive evidence of attendance or receipt.
The Privacy Policy explains how messaging information is processed. These Terms do not describe messages as end-to-end encrypted or inaccessible to the provider.
8.1 Notifications and preferences
Service notifications. Depending on the available features, AthletEye may provide push notifications and in-app notices about direct or team messages, message requests, mentions, replies and reactions; team invitations and membership requests; event invitations, updates, cancellations, attendance and reminders; and account, security, maintenance or other Service announcements. A notification is an alert about the relevant activity, not a substitute for the current information in the Service.
Your choices. Push notifications are optional and are not required to use the application. You can allow or disable them through your device's notification settings and use any additional notification controls made available in the application. Available controls may differ by platform and version. Disabling push notifications does not itself delete messages or events, cancel a subscription or prevent notices from appearing inside the application. Any legally required notice or confirmation will still be provided through an appropriate channel and, where required, a durable medium, as explained in section 22.
Previews and privacy. Depending on the notification and your device settings, a notification may display a sender's name, a message preview, team or event details, or other relevant information on the lock screen or notification centre, where another person using or viewing the device may see it. Use your device's preview and lock-screen controls to manage this visibility. The Privacy Policy explains the processing of personal information for notifications, including relevant device identifiers and delivery providers; accepting these Terms does not replace any required permission or consent.
Delivery and reliance. Notifications may be delayed, duplicated, arrive out of order or not arrive. Delivery and display can depend on network availability, device and operating-system settings, the application version and external delivery services. Check important messages, event details and attendance decisions directly in the application or with the relevant person. A notification does not prove that a message was read, an invitation was accepted or attendance was confirmed, and notifications are not an emergency service. These limitations do not exclude our responsibilities or your mandatory rights under applicable law.
Marketing is separate. Permission to receive operational push notifications and acceptance of these Terms do not constitute consent to promotional or direct-marketing notifications. If we offer promotional push notifications, we will obtain a separate, explicit opt-in within the application and provide an in-app way to opt out. Any other marketing communication remains subject to applicable consent and opt-out requirements. Declining promotional notifications does not prevent you from using the Service.
9. Your content and permission to operate the Service
“Your content” includes the profile details, photos, messages, team information, event information and feedback you submit. You retain the rights you hold in that content. You must have a lawful basis to submit it and must respect other people's privacy and intellectual property rights.
You give us a non-exclusive, royalty-free permission to host, store, reproduce, transmit, format and display your content to the extent necessary to provide the features you use and maintain their security. We may allow service providers acting for us to perform those tasks for the same purposes. The permission covers making content available to the people or audiences associated with the feature and its actual visibility settings.
This permission does not transfer ownership and does not authorise us to publish private messages in advertising. Permission to use content is also not consent to unrelated processing of personal information; the Privacy Policy and applicable data-protection requirements govern that processing.
After account closure, this limited permission continues only to the extent needed to make previously delivered direct messages available to their existing recipient under section 16, or for other limited retention described in the Privacy Policy, such as legally required records and backup handling. It ends when the content is removed or is no longer needed for those purposes. This permission does not override applicable erasure rights or itself establish a lawful basis to retain personal information. We do not obtain an unrestricted, perpetual right to reuse all submitted content after account closure.
10. Acceptable use
You must not use AthletEye to:
- threaten, stalk, harass, exploit or unlawfully discriminate against another person;
- share child sexual abuse material, facilitate child exploitation or encourage abuse;
- promote violence, self-harm or dangerous conduct, or share pornography or non-consensual intimate content;
- publish unlawful content or disclose another person's private information without a lawful basis;
- impersonate a person or organisation, commit fraud or misrepresent an affiliation;
- send spam, repeatedly send unwanted communications or evade communication restrictions;
- upload malware, obtain unauthorised access, disrupt the Service or bypass access controls;
- collect profiles or contact details in bulk without permission, or use obtained information to target people for unrelated purposes;
- infringe intellectual property rights, manipulate ratings or falsify participation records; or
- use the Service for an activity prohibited by applicable law.
Security testing requires our permission unless the activity is otherwise protected by applicable law. Contact athleteye@gmail.com to report a vulnerability without exploiting it or exposing other users' information.
Commercial promotion, advertising of paid coaching or private lessons, and business solicitation are not currently permitted in the Service, including by clubs or team accounts. Ordinary participation in a club or team does not itself constitute prohibited promotion. This rule does not authorise user-to-user payment collection or a marketplace.
11. Reports, moderation and challenges to decisions
Send content, conduct and account complaints to athleteye@gmail.com. Include enough information to locate the relevant account, team, event or message and explain the concern. Share only information reasonably necessary for us to investigate; do not send a password or sign-in code.
Where necessary and lawful, we may ask for further information. We will assess a report in its context and may remove or restrict content, warn a user, restrict a feature, suspend access or close an account when justified by these Terms, safety concerns or a legal obligation.
Measures should be proportionate to the nature and seriousness of the issue. Urgent protective action may be necessary before contacting the affected user. Otherwise, we will provide an explanation and information about how to challenge the decision where required by law, subject to lawful confidentiality and investigation limits.
If you believe we made an incorrect decision, reply to the decision email or contact the same address, identifying the decision and explaining your objection. This does not limit other complaint or appeal rights available under applicable law.
Reporting a concern does not guarantee a particular outcome. Nothing here prevents a report to the competent authorities or use of legal remedies.
If you report unlawful content or an infringement of privacy or intellectual property, identify its location as precisely as possible and explain the right or rule concerned. We will handle notices and urgent safety concerns with the timing and safeguards required by applicable law. We do not require a person reporting harm to obtain the reported user's permission.
12. Our intellectual property and access licence
AthletEye and its licensors retain their rights in the Service's software, branding, design and original materials. Subject to these Terms, you may access and use the Service for its offered purposes. This permission does not grant ownership of our software or allow you to sell access to it, copy its branding or represent yourself as AthletEye.
Restrictions do not override rights you have under applicable law or an applicable open-source licence. The software licence applicable through your distribution channel also governs your licensed copy of the application. For an Apple App Store download, Apple's Standard EULA applies unless a custom EULA has been validly designated for the application and your country or region. These Terms govern AthletEye's Service and do not, merely by being published, replace an app-store EULA or waive mandatory platform or consumer protections.
The access permission is non-exclusive and does not permit sublicensing, commercial resale or access to non-public source code. Necessary technical copies and uses expressly enabled by a feature remain permitted. Ending access is subject to sections 16–19 and applicable law; this licence does not allow arbitrary removal of prepaid access without the remedies that law requires.
13. External services
The Service may use or link to third-party sign-in, mapping, payment or communication services. Their separate terms apply to your direct use of those services where relevant. We remain responsible for obligations that the law places on us; use of an external supplier does not automatically remove those obligations.
An external link or user recommendation is not an endorsement. Review important third-party terms before entering into a separate arrangement.
14. Paid features, subscriptions and trials
Purchases are offered through AthletEye's mobile applications using the Apple App Store or Google Play purchase process, as applicable. The AthletEye website does not take payments. The relevant store identifies the entity processing a purchase and the payment terms that apply to it. AthletEye offers monthly and annual subscriptions, with free trials subject to the conditions of the relevant offer. We do not currently offer separate one-time purchases or charge event fees. Event fees may be introduced in the future only under separately disclosed and accepted terms; these Terms do not authorise a future event charge.
We may offer free trials or other introductory promotions for eligible subscriptions. Whether a trial is available, its duration, eligibility conditions, and any price and billing period that follow it are specified in the offer shown before you subscribe. The offer will also explain any automatic conversion to a paid subscription and how and when to cancel to avoid payment. A trial is not an entitlement to repeated free access through additional accounts.
We may introduce, change or withdraw plans and promotional offers for future subscriptions. A later change to an offer will not shorten a trial you have already started or retrospectively alter charges or entitlements for an agreed paid period. Changes affecting an existing subscription prospectively, including renewal prices, billing periods or included features, remain subject to the notice, agreement, cancellation and remedy requirements of applicable law and the relevant store. Sections 18 and 22 also apply where the Service or these Terms change. These Terms do not promise a permanent trial duration, plan catalogue or price.
Unless you cancel before the deadline shown in the offer, the free trial automatically converts to a paid subscription at the disclosed price and billing period, subject to the applicable store rules and mandatory law. Subscription benefits are for the subscriber's personal use; they do not give every member of a team paid access. Any account association, supported restoration and feature limits are explained in the purchase offer and application.
Before a purchase, the applicable offer must identify the included features, price and currency, billing period, relevant taxes, any automatic renewal and how to cancel. Any eligibility conditions, trial duration and price after a trial must be shown before acceptance. This section does not itself create a free-trial offer or authorise a charge.
For an automatically renewing subscription, renewal and payment follow the disclosed offer and the applicable purchase channel. You can prevent future renewal by following that channel's cancellation process. We will explain the correct route for your purchase and comply with any additional cancellation requirements that apply.
Ending renewal, deleting an account, uninstalling an application and requesting a refund are different actions. Do not assume that one automatically performs the others. In particular, subscriptions billed through an app store must be managed through the applicable store process unless that store provides another supported route.
Prices will not be increased retroactively for a paid period. Any proposed renewal price change will be communicated and any required agreement obtained under applicable law and the purchase channel's rules. You may choose not to renew.
Refund requests may need to be submitted through the store or seller that processed the purchase. We will assist with identifying that route. Store processes do not remove statutory rights you may have against the responsible trader.
AthletEye does not offer an additional voluntary money-back or satisfaction guarantee. This does not limit any refund, withdrawal or other remedy available under applicable law or the applicable app store's refund policy. For assistance with a purchase or refund request, contact athleteye@gmail.com.
Any provider information, geographical address, withdrawal instructions or prescribed form required by applicable law must also be supplied before the relevant contract is concluded, with confirmation in a durable medium where required. These Terms do not waive those separate disclosure requirements.
14.1 Activation, duration and technical requirements
The offer must state when paid access starts and how long it lasts. Access follows the purchase entitlement confirmed through the relevant channel, including any disclosed trial or grace period; it does not depend on when the store transfers its proceeds to us. If a plan has a fixed term without renewal, paid access ends at its disclosed expiry unless another entitlement applies. For renewing plans, the offer must state the renewal period and cancellation deadline, subject to section 25 and mandatory law.
Material device, operating-system, connectivity, functionality, compatibility and interoperability requirements must be disclosed before purchase. If a valid purchase does not activate as promised, contact us with the purchase reference, without sending full payment-card information. We will investigate and provide the remedy required by the agreement and applicable law.
14.2 Apple App Store and Google Play purchases
For Apple-billed purchases, use the subscription controls associated with the Apple Account used for the purchase. For Google Play-billed purchases, use the subscription controls associated with the purchasing Google Account. The store offer and confirmation identify the billing arrangements, trial-conversion conditions and renewal deadlines. Follow those instructions to prevent renewal; deleting the application or your AthletEye account is not a substitute.
If you cannot use those controls or wish to exercise a right against AthletEye, contact us. We will assist and honour any notice that the law requires us to accept. These Terms do not claim that we can directly cancel every store-managed subscription. Any mandatory reminder or change notice must be provided through the responsible purchase channel or by us, as applicable; purchase-channel arrangements do not remove our own legal duties.
Store terms govern the store's purchase and billing services. They do not override non-excludable consumer rights or automatically displace AthletEye's obligations to provide its Service. Sections 15, 24 and 25 explain additional rights.
15. User rights — withdrawal, cancellation and remedies
15.1 Rights preserved by these Terms
Consumers may have mandatory withdrawal, cancellation, conformity, repair, price-reduction or refund rights. Those rights remain available where the law grants them, including when another section refers to an app-store purchase process.
We do not treat account creation, accepting these Terms or opening the application as a blanket waiver of a withdrawal right. If an exception or a request for early performance lawfully affects that right, the required information and any separate express agreement must be provided and obtained through the relevant transaction process.
You may also use the complaint and reconsideration route in section 11, close your account under section 16, and exercise the privacy rights described in section 21. Guarantees and service-defect remedies are addressed in section 24; regional rules appear in section 25. A business user has the rights granted by the agreement and applicable law, but is not automatically entitled to rights reserved to consumers.
15.2 Exercising a withdrawal or cancellation right
Where a withdrawal right applies to your contract with AthletEye, you may send a clear statement identifying the contract and your decision to withdraw to athleteye@gmail.com. You can use the email example below, but it is not compulsory. You do not need to give a reason. For the EU/UK cooling-off rights described in section 25, sending your notice before the applicable deadline is sufficient. This email route does not exclude any other notification method that applicable law requires us to accept.
For a store purchase, the receipt identifies the seller and the relevant store process. You may use that process where appropriate. Contact us if you need help identifying the responsible party. This does not restrict a right to notify or make a claim directly against AthletEye where we are responsible, and a store's discretionary refund policy does not replace statutory rights.
15.3 Example withdrawal email
The following is an optional email example, not a prescribed statutory form. You may use your own clear statement. Where applicable law requires separate withdrawal instructions or a prescribed form, we will provide those before you enter the relevant contract. This example does not replace them.
- To: Mesut Yilmaz, AthletEye; athleteye@gmail.com.
- I/we give notice that I/we withdraw from the contract for the following service: [service or subscription].
- Consumer name(s): [name(s)]. Account email or identifier, if available: [identifier].
- Contract/order date or purchase reference, if known: [date or reference].
- Date of this notice: [date].
16. Closing your account
You may request account closure through the available account settings or by contacting athleteye@gmail.com. Reasonable ownership checks may be needed to prevent someone else from deleting your account.
We do not require you to wait until the end of a paid subscription before requesting account deletion. Subscription cancellation and any refund entitlement must be handled separately as described above. Account deletion can end access to account-dependent features and content even if a separate store subscription remains active.
Deleting your account removes your account and player profile. Your existing direct conversations are closed to new messages. The other participant keeps access to the conversation history, including messages that you sent before deleting your account. Your deleted profile is no longer available through the conversation. Removing the account or profile does not itself remove personal information that may appear within the retained message text.
Account deletion does not perform the separate “Delete chat” action. To remove an entire direct conversation for both participants, use “Delete chat” before deleting your account. The remaining participant can also use “Delete chat” afterward. Conversation history may additionally be removed in accordance with applicable privacy rights, retention limits or other lawful grounds; this section does not guarantee permanent availability.
The Privacy Policy will explain the purpose and duration of retaining delivered messages, how to request erasure of personal information, and the handling of backups or records that must lawfully be retained. A closure request is not a promise that every copy of information in another person's possession disappears immediately. You can contact athleteye@gmail.com after account deletion to exercise applicable privacy rights.
AthletEye does not currently provide an in-app content-export feature. This does not remove any right to obtain information or content that applicable law requires us to provide; contact athleteye@gmail.com to make such a request.
Deleting the team creator's account does not delete the team while other members remain. Those members continue to use the team under the administration rules in section 5. A team can be deleted through the team-deletion action only by its last remaining member.
17. Suspension and termination by AthletEye
We may restrict access or end an agreement when reasonably necessary to address a material or repeated breach, fraud, a serious safety or security concern, or a legal requirement. We will consider less restrictive measures when appropriate and follow the notice and challenge process described in section 11.
Where safe and legally appropriate, we will explain the issue and allow a reasonable opportunity to resolve it. Immediate action may be necessary for urgent harm, unlawful activity or compromised accounts.
Suspension does not automatically extinguish a consumer's refund or other statutory rights. We will determine the consequences for prepaid services under the applicable law and the reason for the restriction. Nothing here authorises continued charging for services we are no longer entitled to charge for.
18. Maintenance and changes to the Service
We may maintain and update the Service to fix defects, improve security, comply with law and develop its features. We will meet applicable obligations concerning service conformity and necessary updates.
When a planned change materially reduces a paid service or we intend to discontinue it, we will give the notice required by law and explain the available cancellation, refund or other remedies. Urgent security or legal action may require shorter notice.
Temporary interruptions can occur, including from network or supplier failures. This does not override commitments we have made or remedies available under applicable law. We do not promise uninterrupted access or guaranteed delivery of every notification.
19. Responsibility and limits of liability
Each party remains responsible for obligations imposed on it by applicable law. Nothing in these Terms excludes liability for fraud, deliberate misconduct, death or personal injury caused by negligence where exclusion is prohibited, or any other liability that cannot legally be excluded or restricted. Mandatory consumer guarantees and remedies are preserved.
Subject to those protections, responsibility for losses must be assessed according to the relevant breach, causation and applicable legal rules. Information or conduct provided by a user does not, by itself, become a representation or guarantee made by AthletEye.
19.1 Responsibility for user activities
You remain responsible under applicable law for losses caused by your own unlawful conduct or breach. We may pursue remedies that the law permits, but this does not make you automatically responsible for all third-party claims connected with an account or require you to pay for losses caused by our own fault. Our role in user-arranged activities is described in sections 3 and 6; it does not excuse a failure to perform our own duties.
19.2 Liability limits and indemnification
The financial cap and loss exclusions in this section apply only to adult users in the United States who can validly agree to them and to business users who do not qualify as consumers under the applicable law. They do not apply to consumers outside the United States or to users who are below the applicable age of majority. Sections 19 and 25 and all non-excludable rights take priority.
Within that scope, and only where applicable law permits, AthletEye's total aggregate liability to you for monetary damages arising from the Service and these Terms, whether in contract, tort or another legal theory, will not exceed the greater of (a) USD 50 and (b) the total fees you paid for AthletEye services, including purchases through an app store, during the twelve months immediately before the first event giving rise to the claim. Purchases across your accounts count toward the same calculation; creating additional accounts does not create additional caps. Connected claims arising from the same event or series of events are considered together. This is a limit on recoverable damages, not a promise of a USD 50 payment.
Within the same scope, and only where legally permitted, AthletEye will not be liable for indirect, incidental, consequential, special, exemplary or punitive damages. This includes lost profit, revenue, business opportunity, goodwill or data only to the extent the loss falls into one of those excluded categories. A loss is not excluded merely because it involves data, and direct recoverable losses are not automatically treated as indirect.
Neither the cap nor the exclusions apply to fraud, wilful misconduct, gross negligence, death or personal injury caused by our negligence, or liability that applicable law does not allow us to limit. They do not reduce statutory refunds, mandatory consumer remedies, non-excludable privacy or data-protection compensation, or rights to seek non-monetary relief. They do not bind a regulator or a person who has not validly agreed to these Terms.
If you are a business user who does not qualify as a consumer and whose business use is permitted under section 10, you must reimburse AthletEye for reasonable losses and legal costs awarded by a final judgment, or included in a settlement you approved in writing, on a third-party claim to the extent caused by your unlawful content, infringement of that third party's rights or deliberate material breach of these Terms. This obligation does not apply to losses caused by our own fault or extend beyond your contribution to the claim. We will notify you promptly, allow a reasonable opportunity to participate in the defence and will not enter a settlement requiring payment or an admission from you without your written approval. This is not a consumer duty to defend or indemnify us.
20. Disputes, governing law and venue of jurisdiction
20.1 Contact and dispute resolution
Contact athleteye@gmail.com with a description of the issue so that we can try to resolve it. Seeking an informal resolution does not itself waive court, regulator or other legal remedies. It is not a mandatory waiting period or a condition that prevents a timely court filing or urgent relief.
Where a mandatory consumer mediation or other alternative-dispute-resolution scheme applies, we will provide its required details and follow the applicable process. An informal complaint to us does not shorten a statutory limitation period. These Terms do not require binding arbitration or membership in an arbitration scheme.
20.2 Governing law and mandatory consumer protections
For the eligible US adult users described in section 20.3, Texas substantive law governs these Terms to the extent a choice of law is permitted. This choice does not exclude applicable federal law or protections that cannot be waived under the law otherwise applicable to a consumer. For other users, applicable law is determined under the conflict-of-laws rules binding on the parties.
These Terms do not deprive a consumer of protections that cannot be excluded under the law applicable to that consumer's contract. The regional provisions in section 25 explain particular protections.
20.3 Texas courts, small claims, class-action waiver and jury-trial waiver
Scope and notice. The Texas court selection and the waivers below apply only if you reside in the United States, are at least 18 and have reached the applicable age of majority, validly accept these Terms after these provisions are expressly brought to your attention, and applicable law permits the relevant provision. They apply to disputes between you and the provider identified above, including a successor following a lawful transfer under section 23, concerning the Service, your account, purchases or these Terms arising from events after that acceptance. A transfer does not expand this scope or revoke an existing rejection of the waivers. They do not apply to minors, users outside the United States, earlier events or an existing dispute. Reaching adulthood does not automatically establish acceptance. For users outside this scope, competent courts are determined under applicable jurisdiction rules.
Texas courts. Subject to the exceptions and mandatory rights below, you and AthletEye agree to the exclusive jurisdiction of the competent state courts in Texas or, where federal subject-matter jurisdiction exists, the competent federal courts in Texas for covered disputes. Applicable venue rules determine the appropriate county, district and court. This agreement does not create subject-matter jurisdiction where none exists or require a court to hear a claim outside its powers.
Small claims court. Either party may bring its own qualifying claim in a competent small claims court, including a Texas Justice Court where appropriate. The Texas forum selection does not prevent a qualifying small claim in another competent location where applicable law permits it. Eligibility, venue, procedure and available remedies are governed by the relevant court's rules. We do not impose an arbitration step before such a claim or promise that every dispute qualifies for small claims treatment.
CLASS-ACTION WAIVER. TO THE EXTENT APPLICABLE LAW PERMITS AND YOU VALIDLY AGREE, YOU AND ATHLETEYE WILL BRING COVERED DISPUTES ONLY IN AN INDIVIDUAL CAPACITY. NEITHER PARTY WILL BRING OR PARTICIPATE IN A CLASS OR COLLECTIVE ACTION, OR A REPRESENTATIVE ACTION ON BEHALF OF OTHERS, CONCERNING A COVERED DISPUTE. This waiver does not prevent shared legal representation or coordination of separate individual claims. It does not waive a proceeding, claim or remedy that applicable law does not allow to be waived, including protected public injunctive relief or proceedings by competent authorities. It does not apply if you timely opt out as described below.
JURY-TRIAL WAIVER. TO THE EXTENT APPLICABLE LAW PERMITS AND YOU KNOWINGLY AND VOLUNTARILY AGREE, YOU AND ATHLETEYE EACH WAIVE TRIAL BY JURY FOR COVERED DISPUTES AND AGREE THAT THOSE DISPUTES WILL BE DECIDED BY A JUDGE. This waiver is mutual. It does not apply where a pre-dispute contractual jury waiver is prohibited, where legally required consent has not been obtained, or where you timely opt out. It does not waive the right to a court hearing or any appeal available under law. Describing the waiver here does not by itself establish that legally sufficient consent has been obtained.
Thirty-day right to reject the waivers. You may reject both the class-action waiver and the jury-trial waiver by emailing athleteye@gmail.com within 30 calendar days after you first validly accept these provisions. State that you reject the court waivers and provide your name, enough information to identify your account and, if known, the acceptance date. No postal letter or reason is required. A timely notice applies to your agreement with AthletEye, including your multiple accounts, and remains effective when you open another account; we may request proportionate information to associate the notice with those accounts. Opening another account does not restart an expired rejection period. Rejecting the waivers does not prevent use of the Service under the other Terms. This rejection right concerns the two waivers; the choice of law and court provisions remain subject to their own scope, exceptions and applicable law.
Mandatory rights, fees and severability. Nothing here removes a protected right to sue in your home jurisdiction, seek urgent judicial relief, report a matter to a regulator or use a compulsory consumer-redress process. Court rules and applicable law govern filing costs, fee waivers and any recoverable legal costs; these Terms do not automatically charge the losing party. The damages cap in section 19.2 does not impose a limit on a court's procedural powers or on fees and costs that the law does not permit us to limit. A competent court determines the formation, scope and enforceability of each provision. If a court rejects the class-action waiver, jury-trial waiver or forum selection, the relevant claim proceeds under the applicable court rules, with any remaining valid provisions continuing only as law permits. An invalid waiver is not automatically rewritten or converted into compulsory arbitration.
Changes. A later change to this section does not apply retroactively to earlier events or existing disputes. A material change requires appropriate notice and renewed valid acceptance, with a new 30-day opportunity to reject changes to the waivers. A previous rejection remains effective unless you subsequently make a separate, express agreement accepting the relevant waiver.
21. Privacy
Our Privacy Policy explains the processing of personal information, relevant recipients, retention and how to exercise privacy rights. We will make the applicable Privacy Policy available for review through the Service and the AthletEye website before these Terms apply to your use. It is a separate privacy notice; agreeing to these Terms is not blanket consent to all processing, marketing or tracking.
22. Changes to these Terms
We may propose changes to reflect changes in the Service, legal requirements or the way the Service operates. We will identify the updated version and effective date, explain material changes and provide advance notice when required. Where agreement is required, we will obtain it through an appropriate process.
A new version does not retroactively change accrued rights or earlier conduct. If you do not accept a proposed material change, we will explain your options, including any applicable right to end the agreement and obtain a remedy for prepaid services.
Material changes requiring your acceptance will be presented on the application home screen with the updated Terms and their effective date. You must affirmatively accept that version to continue using the Service under it. If you decline, continued use under the new Terms will be unavailable, subject to mandatory rights and protection of accrued rights and prepaid services. Declining does not itself cancel an app-store subscription, delete your account or waive a refund, privacy, complaint or other legal right. You may contact athleteye@gmail.com to exercise those rights or request account closure. Any legally required advance notice or durable-medium confirmation will also be provided; the acceptance screen does not replace it. Previous versions will be retained in a version archive.
23. Other terms and contact
If a provision cannot be enforced, the remaining provisions continue to apply to the extent permitted by law. A delay in enforcing a right does not automatically waive it. Nothing in these Terms creates an employment or agency relationship between AthletEye and a user.
An unfair consumer term will not be rewritten merely to give us the closest possible benefit to the invalid term where the law does not allow that result. Mandatory law governs its consequences, including whether the rest of the agreement can continue.
The agreement includes these Terms and the specific offer or other conditions expressly accepted for the relevant service. This does not exclude binding pre-contract information, representations that the law allows you to rely on, or earlier accrued rights. Documents are not added to the agreement merely because an unrelated external link appears on the website.
Transfer to a successor company. You agree that AthletEye may assign its transferable rights and transfer its obligations under these Terms to a successor company that continues the Service, including an LLC formed to operate AthletEye, in connection with incorporation, a reorganisation, merger or transfer of the AthletEye business. We may do so by notifying you without obtaining further consent, except where applicable law requires additional consent or another procedure. The successor must agree in writing to assume and perform the obligations transferred to it, including existing purchase commitments. The transfer must not reduce your contractual or mandatory rights, guarantees, remedies or available defences.
We will identify the successor's full legal name, contact/service address and contact details, the effective transfer date and the effect on your agreement in a direct notice, using the appropriate notice channels under section 22 and a durable medium where required. Notice will be provided before the transfer takes effect where the law requires advance notice and otherwise no later than the effective transfer date. We will also update the provider details in these Terms and the relevant privacy disclosures. A transfer alone does not change subscription prices, expand the licence to your content or change the agreed dispute terms; any separate change remains subject to sections 20 and 22 and applicable law. Personal information may be transferred or processed only in accordance with applicable data-protection law and the relevant privacy notices.
This clause does not release the previous provider from accrued liabilities or obligations that cannot lawfully be transferred or discharged. Any release, additional consent or cancellation right required by law remains subject to that law. After a lawful transfer takes effect, references to the provider, AthletEye, we, us or our include the successor in relation to the transferred agreement. Merely forming a company or changing a store listing does not itself complete this transfer.
Transfer of your account. An account holder may not transfer an account in a way that compromises another person's rights or circumvents eligibility requirements.
After an agreement ends, only provisions that legitimately need to continue for resolving existing obligations, disputes or lawful retention continue to the extent allowed by law. This does not create a perpetual general licence to user content.
For questions, complaints and account support, contact the provider using the verified details at the beginning of these Terms.
24. Guarantees and conformity of the Service
24.1 Statutory guarantees and voluntary guarantees
Statutory guarantees are rights supplied by law, including requirements concerning the quality, description and performance of a service. They are separate from a voluntary money-back or satisfaction guarantee, which AthletEye does not offer. The absence of that voluntary guarantee does not remove statutory remedies or the commitments made in your purchase offer.
24.2 Agreed features, compatibility and updates
We must provide the Service in accordance with the agreed description and the conformity standards that apply by law. This includes applicable requirements concerning functionality, compatibility, accessibility, security and necessary updates. A specific departure from an objective legal conformity requirement is effective only where the law permits it and any required specific disclosure and separate express acceptance have occurred; accepting all of these Terms is not a blanket acceptance of defects.
Follow reasonable instructions for updates needed to maintain conformity and security. Failure to install an update does not automatically cancel every guarantee. Any limit on a claim must satisfy applicable law, including, where required, that the particular problem resulted solely from non-installation after adequate information and instructions were provided.
24.3 Reporting a defect and available remedies
Contact athleteye@gmail.com with the affected feature, a description of the problem and any relevant purchase reference. Depending on the applicable law and the circumstances, remedies may include bringing the service into conformity without charge, repeat performance, a proportionate price reduction, termination, a refund or compensation. We will not substitute a store's discretionary refund decision for a remedy we are legally responsible for providing.
A request for reasonable diagnostic information must not impose unlawful conditions on exercising a right. No short contractual reporting deadline replaces a longer statutory period. Section 25 describes regional rules; statutory rights can also apply in countries not individually listed.
25. Country and region-specific provisions
25.1 Scope and priority
These provisions apply when the law identified governs the relevant consumer contract or affords the consumer mandatory protection. Nationality, interface language and app-store location alone do not determine the applicable law. Consumer status, residence, how the service is offered and the transaction can matter. This section supplements the general Terms and does not restrict more favourable mandatory rights.
25.2 Consumers in the European Union and European Economic Area
Withdrawal. For a covered EU distance contract for services, the consumer normally has 14 days from conclusion of the contract to withdraw without giving a reason. A longer period may apply if required information was not provided. Section 15 explains how to give notice. On a valid withdrawal, the responsible trader must reimburse the sums due without undue delay and within 14 days after being informed, normally by the original payment method, without refund fees.
If you expressly request that a service begin during the withdrawal period, a proportionate amount for service already supplied may be payable only where the legal conditions, including the required information and request, are satisfied. A paid service does not lose its withdrawal right merely because performance starts: the full-performance exception requires the legally necessary prior express consent and acknowledgment. A separate rule can apply to digital content supplied without a physical medium when supply starts with the required prior consent, acknowledgment and confirmation. We do not classify every ongoing subscription as that type of digital content or infer these consents from account creation.
Digital-service conformity. For continuous supply, applicable EU digital-service rules protect conformity throughout the agreed supply period. For a single supply or individual supplies, the liability period for defects covered by those rules is at least two years from supply, subject to national implementation and more favourable rights. Remedies include correction, proportionate price reduction or termination when the legal conditions are met. Necessary updates and any consequences of not installing them are subject to section 24 and the applicable law.
Changes and content after termination. Changes beyond those necessary to maintain conformity require the conditions laid down by applicable law, including a contractual basis and valid reason, no additional cost and the appropriate information. Where such a change negatively affects access or use more than minimally, required advance information must be provided on a durable medium and the applicable right to terminate free of charge must be respected. This can include a 30-day period from notification or modification, whichever is later, subject to the statutory conditions and exceptions. On termination, any statutory right to retrieve eligible user-provided or user-created non-personal content remains available; personal data is handled under data-protection law.
Law, courts and unfair terms. Where EU consumer conflict-of-laws protections apply, a choice of another country's law cannot remove the non-excludable protections of the consumer's habitual residence. Where EU consumer jurisdiction rules apply, consumers can sue in the competent courts of their domicile, and proceedings against them are subject to the protective jurisdiction rules. An unfair term does not become binding because it appears in these Terms.
25.3 Consumers in Germany
Where section 309 no. 9 of the German Civil Code applies to a standard-term recurring-service contract, an initial commitment must not exceed the permitted two-year limit. Tacit renewal must be for an indefinite period with termination at any time on no more than one month's notice. The notice period to end the initial term must not exceed one month. A conflicting fixed renewal period in these Terms does not displace those protections.
Where the online termination rules of section 312k apply, the required termination facility and confirmation must be provided. If a required facility is missing, the statutory consequences remain available. The statutory withdrawal right is separate from terminating renewal.
25.4 Consumers in France
Mandatory French consumer rights apply to covered transactions, including digital-service conformity, withdrawal, renewal and termination protections. For a digital service supplied continuously, the applicable conformity protection covers the agreed supply period. Necessary updates and remedies for non-conformity remain governed by the Consumer Code.
Changes to a digital service beyond those needed for conformity must meet the applicable conditions concerning a contractual basis, valid reason, information and absence of extra cost. Where a change adversely affects access or use beyond a minor effect, any required durable-medium notice and right to terminate without charge apply. A general right to change these Terms does not replace those requirements.
25.5 Consumers in the United Kingdom
Cancellation. For a distance service contract covered by the Consumer Contracts Regulations, the cancellation period normally ends 14 days after the day the contract was made. Missing mandatory information can extend it. Use the notice route in section 15. Reimbursement must be made without undue delay and within 14 days after notice, using the original payment method unless otherwise expressly agreed and without refund fees. Any proportionate service charge requires the legally necessary request and information. Starting an ongoing service does not by itself remove cancellation rights; full performance and the required consent/acknowledgment are relevant to the service exception. Digital content supplied without a physical medium has separate consent and acknowledgment requirements.
Quality and remedies. Where the Consumer Rights Act applies, services must be supplied with reasonable care and skill, and relevant binding information must be honoured. Covered digital content must meet the applicable standards of quality, fitness and description. Remedies may include repeat performance, repair or replacement, price reduction, refund and other statutory relief as appropriate to the contract. These Terms do not remove non-excludable remedies.
Courts. Consumers retain the right to use courts available under mandatory UK jurisdiction rules, including protected rights to bring proceedings where they live. These Terms do not require all UK consumers to litigate in a US court.
25.6 Consumers in Brazil
Where the Brazilian Consumer Protection Code applies, its mandatory protections govern the relevant consumer transaction. For covered distance contracts, the consumer has a seven-day right of regret measured from signing the contract or receiving the product or service, as applicable. It can be exercised through the contact details in section 15; sums paid during that period must be returned promptly with the legally required monetary adjustment. These Terms do not impose a blanket exclusion for the AthletEye service.
Statutory service-quality remedies may include re-performance without additional charge where appropriate, repayment or a proportionate price reduction, at the consumer's choice under the legal conditions. For apparent or readily discoverable defects, the Code provides complaint periods of 30 days for non-durable and 90 days for durable products or services, with the statutory starting points, including completion of services; for hidden defects, time starts when the defect becomes apparent. Applicable tolling and other claim rules remain unaffected. These periods are not a promise that all subscriptions have the same classification or that all rights end after 30 or 90 days.
Nothing here excludes a protected right to bring a consumer claim in the competent court at the consumer's domicile or requires exclusive proceedings in the United States.
25.7 Consumers in Australia
Where the Australian Consumer Law applies, it provides guarantees that these Terms cannot exclude, restrict or modify. These include applicable guarantees that services are supplied with due care and skill, are fit for a disclosed purpose and are supplied within a reasonable time where no time is agreed.
For a major service failure, a consumer may cancel and obtain a refund for the unused portion or keep the contract and seek compensation for the reduced value, as the law provides. Other failures may require correction within a reasonable time, with further remedies if that does not occur. Compensation for reasonably foreseeable loss or damage remains available where the law provides it.
We do not limit every consumer's remedy, at our sole option, to repeating the service or paying its resupply cost. The absence of a voluntary satisfaction guarantee does not change these statutory rights. Sections 19 and 24 remain subject to them.
25.8 Users in the United States
Subscriptions and consumer rights. Applicable federal and state consumer laws remain effective, including requirements concerning disclosure of recurring charges, affirmative consent, renewal or trial reminders where required, and accessible cancellation. No generally applicable US cooling-off period is promised by these Terms; any right provided by applicable law or the purchase channel remains available.
Warranties, liability and indemnification. Sections 19 and 24 apply. These Terms do not impose a blanket disclaimer of every express, implied or statutory warranty, or treat a statement about service availability as a release of our own legal obligations. Section 19.2 sets out the limited scope of the damages cap, loss exclusions and business-user indemnity; its exceptions and mandatory protections apply. The prior document's liability terms and broad consumer indemnities are not incorporated by reference.
Courts, severability and survival. Section 20 governs the available court routes. Section 20.3 provides for Texas courts and qualifying small claims, with separate class-action and jury-trial waivers for eligible US adult users who validly accept them and do not reject the waivers, subject to mandatory rights and exceptions. These Terms require no binding arbitration. The court selection and waivers do not apply to every US user or to minors. An invalid term is dealt with under applicable law, not automatically rewritten to its maximum enforceable scope. Only provisions legitimately requiring continuation survive under section 23; a perpetual general content licence and a fixed five-year indemnity survival period are not created.
25.9 Consumers in Switzerland
Where Swiss mandatory consumer or conflict-of-laws rules apply, the protections they give you remain effective. These Terms do not require you to waive in advance a protected choice of court, including an available court at your domicile. No exclusive US forum is imposed in conflict with those rights.
Swiss law does not generally provide a change-of-mind withdrawal period solely because a purchase was made online. This does not remove rights arising from defects, another applicable law or the relevant store's policy. AthletEye does not add a voluntary money-back guarantee.
25.10 Other countries and territories
Not being individually listed here does not remove a user's mandatory local rights. We will honour applicable rights and provide any required local terms and disclosures for markets in which we offer the Service. Availability remains subject to section 2.
26. Definitions and interpretation
- Provider / AthletEye / we: the provider identified at the beginning of these Terms, currently Mesut Yilmaz as an individual; following a lawful transfer under section 23, the notified successor in relation to the transferred agreement. This does not represent that a company has already been formed or a transfer completed.
- User / you: a person using the Service and, where relevant and lawfully represented, an organisation.
- Consumer: a person qualifying for consumer protection under the law applicable to the particular transaction. Calling an account a “team” or “club” does not alone determine consumer status.
- Business user: a user acting in a business or professional capacity to the extent the relevant law does not treat that user as a consumer.
- Service / application: the mobile applications and related services expressly made subject to these Terms under section 1. The website hosts a copy of these Terms. An internal API or a reference to software does not itself grant public API access or expand the agreed scope.
- Agreement / Terms: these Terms together with the specific offer and other conditions expressly accepted for the relevant service, subject to sections 1, 22 and 23.
- Subscription / paid feature: time-limited access or functionality described in the actual purchase offer. The expression does not itself establish a physical-goods marketplace, a venue booking, an employment offer or a user-to-user payment service.
- Digital content / digital service: the categories defined by the applicable law; data supplied digitally and services for creating, storing, accessing or interacting with digital data can be treated differently. The classification of a purchase must not be inferred solely from the fact that it is made in an app.
- Your content: the material described in section 9. A content licence and a lawful basis for processing personal information are separate matters.
- EU / EEA / UK: the European Union; the European Economic Area (EU states plus Iceland, Liechtenstein and Norway); and the United Kingdom. Switzerland is not part of the EU or EEA. Regional labels, including Brazil, Australia and the United States, describe applicable territorial provisions, not a nationality requirement.
- Durable medium: a means that allows information addressed to you to be stored, accessed for an appropriate period and reproduced unchanged, as required by the applicable law; a properly provided email can meet this requirement. Merely editing a public webpage is not necessarily sufficient.
Local legal definitions and mandatory interpretation rules prevail over any inconsistent general description in this section.
